Notice at Collection of Personal Information Policy for California Resident Donors

Biological Specialty Company, and its subsidiaries and affiliates (collectively, “BSC” or “we”) are committed to protecting your privacy. This Notice at Collection of Personal Information (“Notice”) provides you with information on our use of Personal Information (as defined below) in accordance with the California Consumer Privacy Act (the “CCPA”), as amended by the California Privacy Rights Act (“CPRA”).

Information BSC Collects about Consumers: “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information does not include, for example: (i) information collected, used or disclosed for research purposes, such as information collected after you have signed an informed consent form at one of our donor sites, (ii) information that we have a reasonable basis to believe is lawfully made available to the general public by the consumer or from widely distributed media; (iii) anonymized or de-identified personal information; and (iv) information collected and maintained by us in compliance with the California Confidentiality of Medical Information Act (CMIA), such as clinical laboratory results.

Personal Information Subject to this Notice: This Notice applies solely to all visitors, users and others who reside in the State of California (“Consumers” or “you”) whose Personal Information is collected when visiting our website, https://www.biospeciality.com/ (the “Site”), or the websites of any of our affiliates that expressly link to this Notice (together with https://www.bioivt.com/, the “Sites” and each a “Site”) or if you otherwise provide us Personal Information.

Collection of Consumer Personal Information? In the course of its regular business, BSC may collect the following of Personal Information related to Consumers (“Consumer Personal Information”).

• Identifiers and personal information, such as your name, address, email address, phone number, date of birth and IP address;
• Commercial information, such as information about the donations you are considering;
• Internet or other similar network activity, such as information on your interaction with our Sites;

• Geolocation data, such as information about your physical location or other geolocation data; and
• Inferences that we draw from your Personal Information to create a profile about your preferences.

Business or Commercial Purposes for Collecting Personal Information: Our purposes for collecting and using each category of Personal Information include:

• As described to you when collecting your Personal Information;
• To identify whether you are eligible for participation in one of our donation programs;
• To contact you about donation opportunities;
• To comply with legal or regulatory obligations; and
• To notify you of important updates, promotional campaigns, and other marketing content.

Sale or Sharing of Consumer Personal Information: Note that we do not generally sell or share information as the terms “sell” and share” are traditionally understood. We do not sell or share personal information (including de-identified personal information) to third parties for money. During the past 12 months, we may have engaged in delivering online advertising that was tailored to your interests, but we did not disclose data that would identify you by name, address, or phone number. To the extent “sale” or “share” under the CCPA/CPRA is interpreted to include advertising technology activities such as those disclosed here and in our Privacy Policy as a “sale” or “sharing,” we will comply with applicable law, including the CCPA/CPRA, as to such activity. As described herein, you have the right to opt-out of the “sale” or “sharing” of your personal information. Additionally, you should know that the CCPA/CPRA prohibits third parties to whom we “sell” or “share” personal information from reselling or re-sharing it, unless you have received explicit notice and an opportunity to opt-out of further sales or sharing.

 Retention of Consumer Personal Information: BSC will retain the collected categories of Consumer Personal for so long as we are required for the purposes set out in this Notice, or if we are legally required or permitted to retain such information. When deciding how long to retain your personal information, we consider our legal and regulatory obligations, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information described above and whether we can achieve those purposes through other means. We may also retain your personal information to investigate or defend against potential legal claims in accordance with the limitation periods of countries where legal action may be brought.

 Policy Modification: Subject to applicable law, this Notice may be modified, amended, or rescinded at any time without prior notification.
